Service Agreement

This Childcare services agreement (“Agreement”) between Next Gen DayCare located at 261-200 Southridge Drive, Okotoks, AB, T1S 0B2 (NGDC), and

(Customer). The terms and conditions of these agreements are celebrated below.

Services

The Child Care Provider agrees to provide the necessary daycare to the Customer’s child(ren). Such daily care shall include, but shall not be limited to Child Supervision, Learning and Development, Socialization Opportunities, Nap or Rest Time, Age-Appropriate Curriculum/Activities, Indoor and Outdoor Play, and Specialized Programs (STEAM, environmental and multi-lingual activities. Late Pickup

Every effort must be made to contact NGDC in case of a late pickup. A late pickup fee of $50 per child shall be administered if the Customer is late every 15 minutes. The fee will be charged via direct deposit unless paid onsite.

Holidays

The parties acknowledge and agree that the NGDC will not be available on the Albertan and Canadian statutory holidays.

Services fee and payment

  1. The Customer agrees to pay a non-refundable registration fee of CAD$50. This fee can be paid at the end of this agreement.

4. The service duration lasts for 12 months after this agreement is signed for daycare or the end of the school year for out-of-school care.

5. The payment shall be made on the first day of every month via direct deposit. NGDC charges $50 for every NSF (non-sufficient Funds) transaction that might arise during this agreement.

6. The first payment shall be made upon this agreement signature or 1-week before service starts.

7. Any moneys paid by the Customer to NGDC (fees and tuition) are non-refundable.

Release of Liability and Waiver

  1. The Customer acknowledges that NGEC and their employees will take reasonable precautions to ensure the safety and well-being of the child(ren). The Customer agrees that the NGDC shall not be held liable for any injury, accident, or harm that may occur to the child(ren) during the provision of child care services in situations that are out of NGDC and its employee’s control.

  2. No Party shall be deemed to have waived any provision of this Agreement unless it is expressed in writing.

  3. No failure or delay by a party to exercise any right or remedy provided under this agreement or by law shall constitute a waiver of that or any other right or remedy, nor shall it prevent or restrict the further exercise of that or any other right or remedy.

Damages

If any of the Child(ren), under NGDC supervision, causes damage to the premises other than normal wear and tear on toys, or furniture, the Customer shall be responsible for repairing the damage caused by the Child(ren).

Force Majeure

NGDC shall not be responsible for any claims/damages resulting from delays in performance or non-performance of this Service Agreement due to unforeseen circumstances out of NGDC's control.

Media Release

NGDC will photograph and/or videotape the child(ren) while under their care for educational or promotional purposes, including but not limited to displaying photographs or videos on NGDC’s website, social media platforms, or printed materials. The Customer (please select one):

Termination of care

  1. Either party may terminate this agreement by providing written notice to the other party at least 30 days prior to the desired termination date. Any outstanding fees owed to NGDC shall be settled in full.

  2. If termination occurs before the end of the current billing cycle, no money will be returned to the Customer.

  3. This clause is voided in case NGDC wants to terminate the services for the Customer and/or their children who accumulated a total of three offences/warnings, according to NGDC Family Handbook Termination policy.

Miscellaneous

  1. The Customer is responsible for providing their child(ren) bedsheets for nap time, to collect them at the end of every week and return them washed at the beginning of every week. If a child soils the bedsheet, parents are also responsible to collect and wash them. A $10 laundry fee will be charged to the Customer if bedsheets are not collected and washed at the end of every week.

  2. The Customer is responsible for providing meals for their child(ren) during childcare hours. That should include a minimum of 1 snack and a full meal for part-time and 2 snacks and 1 full meal for full-time.

  3. The Customer is responsible for providing and labelling diapers and wipes for their child(ren).

  4. This Agreement, including any registration, schedules and appendixes, constitutes the entire agreement between the parties, and supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations, and assurances between them, whether written or oral.

  5. This Agreement shall be binding upon and accustomed to the benefits of the parties and their representatives.  The provisions of this Agreement are severable meaning if any provision is invalid or unenforceable, it shall not affect the validity and enforceability of the rest of this Agreement.

  6. This Agreement may be executed in one or more counterparts. Each counterpart shall be considered an original.

  7. This Agreement and any disputes shall be governed in accordance with the laws of Alberta, Canada.

  8. In consideration of the child's participation in the NGDC Program, the Customer hereby consents to Program Employees providing Emergency Health Care to the child in the event that the Customer and emergency contacts are unreachable. Emergency Health Care means any medical or surgical treatment that is necessary to preserve the life, limb or function of the child, as determined by a qualified health care provider. The Customer agrees to reimburse Program Employees for any costs incurred in providing Emergency Health Care to the child and to indemnify and hold harmless Program Employees from any claims, damages or liabilities arising from or related to such Emergency Health Care.

IN WITNESS WHEREOF, the Parties have executed this Agreement as of the date stated above and Customer acknowledges that they have read, understood, and agree to abide by the terms and conditions in this Agreement by checking the box below.
